TWA winding down toward transition

THE WOODLANDS – With the transition of governance just around the corner, The Woodlands Association is winding down.

The homeowners group only has one scheduled meeting left for the year on Nov. 19. Although the board hands over its responsibilities to The Woodlands Township on Jan. 1, members are technically still a board until all obligations as of Dec. 31 are met and the articles of dissolution are filed, said attorney Brett Strong during the TWA workshop Monday afternoon.

Strong explained how loose ends will be tied up and recommended the board authorize the president of the township to sign its articles of dissolution, which could be ready as early as March, and have the president sign any other documents on TWA’s behalf after Jan. 1.

When the articles of dissolution are filed, the TWA board will be no more but the agency will stay active for up two years to resolve any lawsuits filed against it prior to 2010, Strong said. Any actions will be handled by the township on behalf of the TWA.


“There are lots and lots of moving parts,” Strong said.

The township hired Strong earlier this year to help make a smooth transition. His law firm is transferring all the real property, with assigned covenants, to the township, as well as personal property, contracts and trademarks.

He also is filing a global record to state the intent of the transition agreements to transfer all property and assign all easements and leases to the township. The document will ensure that if any of the 1,500 properties get overlooked in the process they still fall under the township.

In other TWA business, Director of Parks and Recreation Chris Nunes presented an agreement with the Tomball Independent School District to allow Creekside Forest Elementary School to use Rob Fleming Park in exchange for resident use of the school’s parking lot. Board members appeared to support the measure and will vote on it during their meeting next week.
