Hendricks re-indicted for sexual assault

John Michael Hendricks, 22, was re-indicted by a San Jacinto County Grand Jury for Sexual Assault of a Child. The re-filing of the indictment came because further investigation showed that the date the alleged incident occurred was listed incorrectly on the initial police report.
“As I was looking into it I saw that the investigating officer had drawn a one before the nine, so we thought it had occurred on the nineteenth and not the ninth,” said San Jacinto County First Assistant Criminal District Attorney Jonathan Petix. Petix stated that since all indictments filed by the Criminal District Attorney’s Office use the phrase “on or about” to describe the date an alleged event occurred the charge would have held up.
However, the prosecutors wanted to be sure. The newly filed indictment alleges that in December of 2006 Hendricks allegedly caused the penetration of an unnamed minor, under the age of 17, with his finger.
According to the Texas Penal Code Sexual Assault of a Child is a Second Degree Felony. If found guilty Hendricks could face a prison sentence of 2-20 years and a fine not to exceed $10,000.
